Terms and Conditions

Please read these Terms and Conditions carefully before registering for your CULTIVAMOS Tour (the “Trip”). By submitting your registration and deposit, you (“Participant”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree to these terms, do not register for the Trip.
1. Registration and Payment
1.1 Deposit
A non-refundable deposit of $1,000.00 USD is due upon signing these Terms and Conditions and completing your registration. Your spot on the Trip is not confirmed until Cultivamos Travel receives your deposit in full.
1.2 Final Payment
The remaining balance of the total Trip cost is due no later than ninety (90) days prior to the scheduled departure date. Failure to remit final payment by this deadline may result in cancellation of your reservation, forfeiture of your deposit, and release of your spot to waitlisted participants.
1.3 Accepted Payment Methods
Cultivamos Travel will communicate accepted payment methods at the time of registration. All payments must be made in U.S. dollars. Payments are not considered received until funds have cleared.
2. Cancellation and Refund Policy
2.1 Participant-Initiated Cancellation
All cancellation requests must be submitted in writing to Cultivamos Travel at info@cultivamos.com. The effective date of cancellation is the date on which Cultivamos Travel receives written notice. The following refund schedule applies:
- 121 or more days prior to departure: full refund will be issued within thirty (30) days of receipt of cancellation notice. Participant may elect to transfer deposit to a future trip date.
- 61 to 120 days prior to departure: fifty percent (50%) refund of total amount paid as of receipt of written notice of cancellation. Refund will be issued within thirty (30) days of receipt of cancellation notice.
- 60 days or fewer prior to departure: no refund will be issued. All payments are forfeited. At the discretion of Cultivamos Travel, you may arrange for a qualified substitute participant to take your place on the Trip, pursuant to the terms of Section 3 below.
3. Substitutions
If you are unable to attend the Trip, you may arrange for a qualified substitute to take your place, subject to the following conditions:
- Substitution requests must be submitted in writing to Cultivamos Travel no fewer than ten (10) days prior to departure.
- Substitutions are permitted only if space allows, as determined by Cultivamos Travel in its sole discretion.
- The substitute participant must complete all required registration forms and agree to these Terms and Conditions in full prior to the departure date.
- A substitution processing fee may apply. Cultivamos Travel will notify you of any applicable fees at the time of the substitution request.
- Both the original registrant and the substitute are jointly responsible for ensuring all documentation, registration, and payment obligations are fulfilled.
4. Age Requirement
All Trip participants must be eighteen (18) years of age or older as of the scheduled departure date. The Trip includes wine tastings and other alcoholic beverages as a central component of the experience, and participation is restricted to adults. Proof of age may be required at registration or at any point during the Trip. Any participant found to be under the minimum age requirement will be denied participation without refund. By registering, you represent and warrant that you meet this age requirement.
5. What Is Included
The Trip price includes the following for all participants during the five (5) days of the scheduled itinerary:
- Ground transportation within Portugal as specified in the Trip itinerary, including transfers between accommodations, wineries, and experience venues.
- Accommodations for the duration of the Trip, as specified in the itinerary.
- Three (3) meals per day (breakfast, lunch, and dinner) at group dining experiences, including alcoholic beverages (wine, beer, and spirits) served as part of scheduled group meals.
- Winery visits, guided tastings, and all other culinary or cultural experiences listed in the confirmed Trip itinerary.
- Wine tastings conducted as part of the official Trip program at scheduled venues.
6. What Is Not Included
The following are expressly excluded from the Trip package price and are the sole financial responsibility of the participant:
- International airfare to and from Lisbon, Portugal (LIS), including any applicable baggage fees, seat selection fees, or other airline charges.
- Airport transfer to designated group meeting point in Lisbon and from final group destination in Lisbon.
- Passport and visa fees, travel documentation costs, or any costs associated with meeting entry requirements for Portugal or any transit country.
- Personal expenses of any kind, including but not limited to souvenirs, personal shopping, laundry, medical expenses, and communications.
- Optional spa services or wellness treatments, whether offered at lodging properties or elsewhere.
- Non-lodging hotel charges, including but not limited to incidentals, room service, minibar charges, in-room entertainment, parking, and any other charges billed directly to Participant’s room account.
- Alcoholic beverages purchased outside of scheduled group meals and official Trip experiences, including beverages purchased at bars, shops, or independently at meal venues.
- Travel insurance of any kind (see Section 15 for recommendation).
- Any costs incurred as a result of changes to Participant’s itinerary, including early departure, delayed return, or deviation from the group schedule.
7. Accommodations and Room Assignments
Accommodations for the Trip are as specified in the confirmed itinerary. The following terms apply to all lodging arrangements:
- Room assignments are made solely at the discretion of Cultivamos Travel. While Cultivamos Travel will make reasonable efforts to accommodate requests submitted in writing at least thirty (30) days prior to departure, specific room types, configurations, floor levels, or views cannot be guaranteed.
- Non-lodging charges billed to a participant’s room account, including incidentals, room service, minibar, telephone, and similar charges, are the sole financial responsibility of the participant and must be settled directly with the property prior to checkout.
- Cultivamos reserves the right to substitute accommodations of comparable quality if the originally planned property becomes unavailable, without refund or adjustment to the Trip price.
9. Mobility and Accessibility
The Trip includes visits to working vineyards, historic estates, and other venues that may involve uneven terrain, cobblestone surfaces, stairs, hillside paths, and limited accessibility infrastructure. Cultivamos does not represent or warrant that all venues are accessible to individuals with mobility limitations or disabilities.
Participants with mobility considerations, disabilities, or physical conditions that may affect their ability to navigate Trip venues are strongly encouraged to contact Cultivamos Travel in writing prior to registration to discuss the itinerary in detail. Participants are solely responsible for assessing their own suitability for the physical demands of the Trip. Cultivamos Travel will make reasonable efforts to provide information about venue accessibility upon request but cannot guarantee that accommodations or alternative arrangements will be available at every location.
By registering, you represent that you have assessed the physical requirements of the Trip and determined that you are able to participate. Cultivamos Travel assumes no liability for injury or inconvenience arising from accessibility conditions at any venue.
10. Limitation of Liability and Release
10.1 Assumption of Risk
Travel, particularly international travel involving wine tastings, vineyard visits, and related activities, involves inherent risks, including but not limited to personal injury, illness, property damage, and inconvenience.
By registering for the Trip and accepting these Terms and Conditions, you acknowledge that you are aware and understand that the Trip includes potentially dangerous activities and involves the risk of personal or psychological injury, pain, suffering, temporary or permanent disability, death, property damage, and/or financial loss. You acknowledge that any injuries that you sustain may result from or be compounded by the actions, omissions, or negligence of the company, including negligent emergency response or rescue operations of the company.
Notwithstanding the risk, you acknowledge that you are voluntarily participating in the activities with knowledge of the danger involved and hereby agree to accept and assume any and all risks of injury, disability, death, and/or property damage arising from your participation in the Trip, whether caused by the ordinary negligence or gross negligence of Cultivamos Travel or its employees or agents or otherwise.
10.2 Limitation of Liability
To the maximum extent permitted by applicable law, Cultivamos Travel, its officers, directors, employees, agents, representatives, contractors, affiliates, and successors (collectively, “Cultivamos Parties”) shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with the Trip, including but not limited to:
- Personal injury, illness, disability, or death of any participant, regardless of cause.
- Loss, theft, or damage to personal property or baggage.
- Delays, cancellations, or changes to any transportation, accommodations, or activities.
- Acts or omissions of third-party suppliers, vendors, operators, or service providers.
- Weather conditions, natural disasters, acts of God, or force majeure events.
- Political unrest, civil disturbance, terrorism, or government action.
- Medical conditions, reactions to food or beverages, including alcohol, or health-related incidents.
On behalf of yourself, your heirs, assigns, and legal representatives, you hereby expressly waive and release any and all claims, now known or hereafter known, against Cultivamos Travel, and its officers, directors, managers, employees, agents, affiliates, shareholders/members, successors, and assigns (collectively, “Releasees”), arising out of or attributable to your participation in the Trip, whether arising out of the ordinary negligence or gross negligence of Cultivamos Travel or any Releasees or otherwise. You covenant not to make or bring any such claim against Cultivamos Travel or any other Releasee, and forever release and discharge Cultivamos Travel and all other Releasees from liability under such claims.
In no event shall the total aggregate liability of the Cultivamos Parties to any participant exceed the amount actually paid by that participant to Cultivamos for the Trip.
10.3 Third-Party Suppliers
Cultivamos Travel acts solely as an organizer and coordinator of the Trip. Hotels, wineries, restaurants, and other service providers are independent third parties. Cultivamos Travel makes no warranties or representations regarding the services, safety, quality, or conduct of any third-party provider and expressly disclaims all liability for acts or omissions of such providers.
11. Force Majeure
Cultivamos Travel shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions arising from causes beyond its reasonable control, including but not limited to Acts of God, including earthquakes, floods, fires, hurricanes, or other natural disasters; epidemic, pandemic, public health emergency, or related government-imposed travel restrictions or quarantine requirements; war, armed conflict, terrorism, civil unrest, riot, or sabotage; strikes, labor disputes, or industrial action affecting transportation or hospitality providers; government action, regulatory changes, border closures, or travel advisories issued by the U.S. Department of State or equivalent authority; supplier insolvency, closure, or cancellation outside the control of Cultivamos; failure of utilities, infrastructure, or communications systems.
In the event of a force majeure occurrence, Cultivamos Travel will use commercially reasonable efforts to provide alternative arrangements or to reschedule the Trip. If Cultivamos Travel determines, in its sole discretion, that the Trip cannot proceed or be rescheduled within a reasonable time, it may cancel the Trip and issue refunds in accordance with Section 2. Beyond such refunds, Cultivamos Travel shall have no further liability to participants arising from a force majeure event.
12. Participant Responsibilities
You agree to:
- Obtain a valid passport and any required visas or travel authorizations for Portugal and any transit countries prior to the departure date.
- Ensure you are in adequate physical and mental health to participate in all planned Trip activities. Participants with known medical conditions are encouraged to consult a physician prior to travel.
- Comply with all applicable laws and regulations of Portugal and any other jurisdiction visited during the Trip.
- Behave respectfully toward fellow participants, Cultivamos Travel staff, and third-party providers. Cultivamos Travel reserves the right to remove any participant whose conduct is disruptive, dangerous, or otherwise incompatible with the group experience, without refund.
- Consume alcohol responsibly. Cultivamos Travel will not be responsible for any consequences arising from excessive alcohol consumption by a participant.
13. Itinerary Changes by Cultivamos Travel
Cultivamos Travel reserves the right to make changes to the Trip itinerary, accommodations, or activities at any time for reasons including, but not limited to, safety concerns, weather conditions, supplier cancellations, or force majeure events. Cultivamos Travel will make commercially reasonable efforts to provide comparable substitutions but does not guarantee that all scheduled activities will take place as originally planned. No refund will be issued for minor itinerary changes or supplier substitutions of comparable quality.
14. Alcohol Use, Health, and Allergies
The Trip includes scheduled wine tastings and alcoholic beverages with group meals. You acknowledge that consumption of alcohol carries inherent risks. Cultivamos Travel does not assume liability for any injury, illness, or incident resulting from a participant’s voluntary consumption of alcohol during the Trip. Participants are solely responsible for their own conduct and well-being.
Participants with dietary restrictions, allergies, or medical conditions that may be affected by food or beverage service are responsible for notifying Cultivamos Travel in writing at least thirty (30) days prior to departure. Cultivamos Travel will make reasonable efforts to accommodate such needs but cannot guarantee that all requests can be fulfilled.
15. Travel Insurance
Purchase of comprehensive travel insurance, including coverage for trip cancellation and interruption, emergency medical evacuation, and medical expenses, is strongly recommended and is the sole responsibility of each participant. Cultivamos Travel is not responsible for any losses, costs, or damages that would have been covered by travel insurance had the participant obtained it.
16. Privacy and Photography
By registering for the Trip, you consent to Cultivamos Travel collecting and using your personal information for the purposes of administering the Trip, communicating with you, and fulfilling obligations to third-party service providers. Cultivamos Travel will not sell your personal information to third parties. Photography and videography may be captured during the Trip by Cultivamos Travel staff and may be used for marketing or promotional purposes. If you do not wish to appear in such materials, please notify Cultivamos Travel in writing prior to the Trip.
17. Dispute Resolution and Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of or in connection with the Trip or these Terms and Conditions shall first be submitted to non-binding mediation in Florida. If mediation is unsuccessful, disputes shall be resolved by binding arbitration conducted in Florida in accordance with the rules of the American Arbitration Association.
You acknowledge and agree that you are waiving your right to a jury trial and to bring or participate in a class action lawsuit.
18. Severability and Entire Agreement
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between you and Cultivamos Travel with respect to the Trip and supersede all prior communications, representations, or agreements, whether written or oral.
